Half-Blood Relatives
Cal. Prob. Code § 6406
The rule
Relatives of the half blood inherit the same share they would if of the whole blood — California draws no distinction.
In plain English
In California, half-blood relatives inherit the same amount as whole-blood relatives when it comes to intestate succession. This means that whether a relative is related by one parent or both, they will receive an equal share of the estate.
Worked example
John dies intestate, leaving behind his mother, a full-blood brother, and a half-blood sister. Under California law, both the brother and sister will inherit equal shares of John's estate, despite the sister being a half-blood relative.
Memory hook
Half-bloods get the same slice of the pie in California!
The trap
Exams may present scenarios where students mistakenly think half-blood relatives receive less than whole-blood relatives, leading to incorrect distributions.
How examiners test it
Questions often involve family trees with both half-blood and whole-blood relatives to test understanding of inheritance shares under California law.
